yes they are a fallen house, because they don't have any rank in the shinigami squad, but ishin return and ichigo take the lead who know,maybe shiba clan will rise up again

The way Byakuya talks about it I'd rather say they were cast out from the nobility for some crime or the like.

Seems a little weird to remove a house from high nobility just because the eldest member died...
